Partial payment to painter?
had a house painter come and work on my home. The agreement was 00 for the home everything included, 5 year warranty, have it in writing. As soon as he left (he worked for 1 day prepping and then 4 hours total doing the house) we found over 40 areas that needed to be redone. He then came back twice to do them. Then we saw that one entire side was peeling between the siding grooves. He said its the wood delaminating and the SW guy agreed (his personal friend from SW not a third party source in my opinion). He said he will come back, apply a anti-delaminating agent, and repaint entire side. Well, we told him that the front know has all of his 12+ touch ups showing and we need those boards repainted as well. Took him 10 days to get back with us, says he is really busy this time of year and doesn’t have time to keep running back and forth and fixing the issues. He wants us to pay 1300 and he said "I’ll cut my losses" He is insured and has an amazing record on the BBB. He said he’ll keep the warranty but I’m like how will you keep it if you wont even finish the job?
Is that a fair amount? We are left with one side to redo ourselves plus about 20 boards on the front that need redoing thanks to "mismatched touchups"?
DO I PAY OR PAY NOTHING? WE CAN FINISHED THE JOB OURSELVES AND HE IS AT ABOUT HALF THE BID FOR ABOUT 70% of work finished

At this point I believe that Mark and I really doesn’t feel comfortable letting you or your workers back over at our house. I also can’t take Friday afternoon off now because of short notice.
I think we are willing to take the 00 you offered last night on the phone to have you walk away MINUS the board for deck that had a chunk out of it (10 bucks) and the solar light broken (20 dollars since they don’t come in anything other than sets)
I’m will give you a check for 70 tomorrow if you still want it and we can call it a day. I know you said the warranty will still be in effect and that’s nice of you to offer. If you mean that -then if something major comes up and you actually show up and fix it, we know that you kept your word. I wouldn’t necessarily refer you to anyone but I will not stain your reputation or file any complaints or anything like that if you are willing to keep the warranty , understanding that there has been issues with the work and now we have to redo almost two sides ourselves.
Mark is going to have to fix the side himself now and it’d be nice if we could get the paint we need at your prices. That would probably be the last thing we’d want from you is to call in an order for another 5 gallons of paint at your contractor price and then we could go pick it up at the SW in Gardner tomorrow or this weekend. This would be a nice gesture on your part considering we are time crunch and half to get that side finished before we leave for vacation for a long while, in which there will be rain that will get into those boards.
It ‘s disappointing that you called us in such a haste and made it sound like our house isn’t worth your time. It was amazing how quickly you walked away from 00 profit and didn’t even blink. We have been nothing but polite and VERY patient with you through all the mistakes, no show for appts, incorrect work, and other issues we went through. We have not been picky, verbally rude, or demanding. If you would have just told us that you were busy for the next week we would have said fine lets work something out when we get back from vacation. But instead you called us angry a week after I tried to get ahold of you, told us you don’t care about finishing and offered the 00 to walk away. We were in shock.
I am not picky. About 70% of the work has been done and now a side has to be completely redone, scrapped, primed, and repainted. Another side needs to be completely repainted
